Terms & Conditions

Last updated: 14 September 2026

1. About these Terms

1.1 Company and scope

These Terms and Conditions govern your use of websites, applications, digital content and related services offered by UAB “Yellow Forty Three”, company code 308117827, registered office Manufaktūrų g. 7-175, LT-11342 Vilnius, Lithuania. In these Terms, “Company”, “we”, “us” and “our” mean that company. “You” means the person using a service. Together, the offerings covered by these Terms are the “Service”; an individual offering may also be called a “Product”.

These Terms provide a framework for our business and products, including workout, health, wellness and education applications. Provisions concerning accounts, purchases, subscriptions, uploads, coaching, integrations or artificial intelligence apply only when the relevant feature is actually offered. At the date above, yellow43.com is a promotional website: it does not offer accounts, purchases, subscriptions, user submissions or AI features. Describing a possible product feature here is not a promise that it is available or will be launched.

1.2 Your agreement and eligibility

By downloading, installing, accessing or using the Service, you agree to these Terms and confirm that you have legal capacity to enter into this agreement. The Service is intended for people aged 18 or over. If you do not agree or do not meet that age requirement, do not use it. Where no account is required, using the Service signifies acceptance to the extent that applicable law permits agreement in that manner.

1.3 Related information and mandatory rights

Our Privacy Policy explains our personal-data practices and should be read alongside these Terms. Any additional product terms, purchase disclosures or guidelines form part of the agreement only where they are actually supplied to you and identified as applicable before you agree to the relevant offering. A reference to a future feature does not incorporate an unavailable document.

English is the governing language of these Terms, subject to mandatory language and consumer protections. Translations assist understanding; where applicable law gives a translation priority or allows you to rely on it, that law prevails. Nothing in these Terms removes rights or remedies that cannot lawfully be waived.

2. Changes to these Terms

We may revise these Terms to reflect legal requirements, changes to our business or Service, technical or security updates, new functionality or market conditions. When a revision materially affects your rights or use of the Service, we will give reasonable advance notice through an appropriate channel, such as the website, an in-product notice or email where we have your address.

A minor revision that does not materially affect your rights or obligations may take effect when published. The date above identifies the latest version. Continuing to use the Service after a revision takes effect indicates acceptance where permitted by law; we will obtain further agreement if the law requires it. If you reject a revision, stop using the affected Service and cancel any relevant subscription before the revision takes effect. Any statutory cancellation, refund or other remedy remains available.

3. Accounts and profiles

If a Product offers registration, you may need a user profile to access particular features. Provide accurate, complete information in good faith and keep it current. Inaccurate or outdated details can prevent features from working correctly or stop important notices reaching you. Registration does not create an exception to the minimum age of 18.

Keep your credentials confidential and safeguard access to your profile. You are responsible for activity carried out through it, subject to applicable law. Notify us promptly if you suspect unauthorized access or a security breach. We are not responsible for losses caused by your failure to protect credentials to the extent that the law permits this exclusion.

We may suspend or close a profile, or restrict access, where we reasonably believe information supplied is false, incomplete or misleading, or your conduct breaches these Terms or the law. Such action remains subject to mandatory notice, consumer and other legal protections.

4. Using the Service and its content

4.1 Ownership and licence

The Service's text, images, graphics, logos, icons, interfaces, software, arrangements of information and other materials are “Content”. Except for your own materials, Content belongs to us or our licensors and is protected by intellectual-property laws. Rights not expressly granted remain reserved.

While you comply with these Terms, we grant a limited, nonexclusive, nontransferable and revocable licence, without sublicensing rights, to access the Service for personal, noncommercial use. If an app is available, the licence also permits downloading, installing and using it on a compatible device that you own or control for those purposes.

Unless we expressly permit it or applicable law gives you a right that cannot be excluded, you must not reproduce, adapt, translate, modify, distribute, sell, license, publish or publicly display Content; make derivative works; or decompile, reverse engineer or disassemble the Service.

4.2 Your materials

If a feature allows submissions, your notes, messages, images, text and other uploaded or shared materials are “User Content”, whether public or private. You retain your intellectual-property rights in them. We do not acquire ownership of their copyright.

You grant us permission to use User Content only as reasonably necessary to provide, operate, maintain and improve the Service, as described here and in the Privacy Policy. We may retain registration details and User Content for those purposes and legal obligations, subject to the Privacy Policy and applicable data-protection requirements. This permission does not remove your privacy rights.

Your use and submissions must comply with these Terms and the law, respect others' intellectual-property, privacy and other rights, and not breach duties you owe to another person.

4.3 Equipment, changes and support

You arrange and pay for the devices, software, internet connection, mobile data and other services needed to use a Product. Check any compatibility and minimum system requirements disclosed for it.

We may add, change, suspend or remove features, including paid features, subject to our contractual commitments and applicable law. Where changes adversely affect your use, you may stop using the Service and cancel your subscription. This does not replace any right to notice, continued conformity, a price reduction, termination or a refund required by law.

Except where the law requires otherwise, you use the Service at your own risk. Device or system damage, data loss and injury connected with use are subject to the exclusions and limits in Sections 7, 8 and 10. We do not promise a particular level of optional customer support. Any voluntary support may change or end, but required consumer assistance and handling of privacy rights remain unaffected.

5. Distribution platforms, external content and other users

If you obtain a Product through an app store or other distribution platform, its applicable terms also govern your dealings with that platform. You must comply with those terms and pay any associated platform fees. Where applicable, the distributing platform is a third-party beneficiary of these Terms and may enforce provisions protecting its rights.

The Service may link to external websites, advertisements or services. We do not control or endorse external content or guarantee its accuracy, reliability or legality. Purchases and other dealings with an external provider are between you and that provider, and you are responsible for deciding whether to proceed.

Where user-sharing features exist, each contributor is responsible for their own User Content. Unless a Product states otherwise, we do not routinely prescreen every submission and cannot guarantee its accuracy, quality or suitability. Interactions with other users, on or off the Service, are at your own risk.

To the extent permitted by law, we are not liable for external content, dealings with distribution platforms, other users' content or conduct, or disputes with them. On that same basis, you release the Company and its officers, employees, affiliates, agents and successors from claims, demands, losses, damages and actions, whether known or unknown, arising from those matters. This release does not affect liability or rights that the law prevents you from releasing.

6. Purchases, subscriptions and withdrawal

6.1 Price and purchase information

A Product may offer paid content, premium features or coaching, including recurring subscriptions. Before a purchase, the applicable offer will identify its price, taxes, billing frequency, duration, renewal arrangements and cancellation method. Any trial, promotional period or additional contractual refund entitlement must be described in the purchase information supplied to you. No price, trial or paid plan is created merely by these Terms.

By purchasing, you agree to pay the disclosed price and applicable taxes. For a subscription, you authorize the disclosed recurring charge. A subscription renews at the end of each stated billing period, such as monthly or annually, unless you cancel before the next renewal through the mechanism provided for that purchase. We will comply with any mandatory consent, reminder and renewal-disclosure requirements.

6.2 Cancellation and refunds

Use the cancellation controls identified at purchase or in the relevant Product. For a platform-managed subscription, use that platform's applicable subscription controls. If the stated cancellation method is unavailable or you need assistance, contact hello@yellow43.com. A timely cancellation stops the next renewal. The supplied purchase information will explain when access ends and any contractual refund arrangement.

Cancellation of future renewals is distinct from withdrawing from a purchase or seeking a remedy for a defective service. These Terms do not create a general “no refunds” rule. Any refund restriction disclosed for a particular purchase is subject to the withdrawal rights below and mandatory consumer remedies. An unpublished or unavailable subscription policy does not form part of your agreement.

6.3 Fourteen-day withdrawal

If you are a consumer in the European Economic Area or United Kingdom, you may withdraw from a qualifying distance purchase within 14 days after the contract is concluded, without giving a reason, subject to applicable exceptions. We also offer consumers resident in Switzerland a contractual 14-day withdrawal right on the same basis described in this subsection; this is a voluntary benefit, without restricting rights otherwise available to them.

For paid digital content supplied without a physical medium, such as a downloadable video or document, the withdrawal right ends when supply begins only if the required conditions have been met. These include your prior express consent to immediate supply, acknowledgement that this causes loss of the withdrawal right, and the required contract confirmation. Accepting these Terms alone does not provide that separate consent or acknowledgement.

For a service, including an ongoing digital service, merely starting use does not automatically remove the withdrawal right. If you expressly request performance during the withdrawal period, we may charge a lawful proportionate amount for what has been supplied before withdrawal, provided the required information and request conditions were satisfied. The right ends after full performance only where the relevant legal requirements, including express consent and acknowledgement, have been met. Without the required conditions, we will not treat access alone as a waiver.

Send a clear withdrawal statement to hello@yellow43.com or our registered office before the period expires. You may use the model below, but it is optional. Where an online withdrawal function is legally required for the relevant purchase, it will also be available through the purchasing interface throughout the applicable period, with an acknowledgement of submission. We will make any refund due within the period and by the method required by applicable law.

To: UAB “Yellow Forty Three”, Manufaktūrų g. 7-175, LT-11342 Vilnius, Lithuania; hello@yellow43.com.
I give notice that I withdraw from my contract for the following service or digital content: [description].
Ordered on: [date].
Consumer's name and address: [details].

7. Health, wellness and results

7.1 Purpose and professional care

Any fitness, nutrition, sleep, stress, mindfulness, educational or wellness content offered through the Service is intended for general information and self-guided use. It is not a substitute for medical advice, diagnosis, treatment, therapy or professional healthcare. These Terms do not classify a future Product's regulatory status; any specific regulated purpose or status must be addressed in that Product's own information.

Suggestions may be generic or based on limited information and may be unsuitable for your circumstances. Before starting exercise, dietary changes or other wellness activities, consult a qualified healthcare professional, particularly if you have a medical condition or limitation, take medication, are pregnant, breastfeeding or postpartum, have recently been ill or had surgery, or have a personal or family history that may affect safe participation.

Do not use the Service for emergencies. Seek immediate professional assistance or contact local emergency services for urgent symptoms, serious physical distress, suicidal thoughts or severe mental distress. The Service does not monitor your condition or provide emergency intervention.

Using it does not establish a clinician-patient or therapeutic relationship. Coaches, support staff and automated responses do not provide medical consultations through the Service. Even a contribution from a qualified professional is general information unless a separately identified professional service expressly states otherwise.

7.2 Accuracy and suitability

We aim to provide useful information but do not guarantee the accuracy, completeness or reliability of recipes, exercises, product descriptions or wellness guidance. Review manufacturers' current instructions, nutritional information, allergen warnings and labels. If you have an allergy or medical condition, do not rely only on the Service; check the product's physical label and seek appropriate advice.

Activity and health measurements, whether entered manually or received from another device or app, are for general wellness and personal use. They are not clinical assessments or substitutes for professional measurements. To the extent permitted by law, we are not responsible for inaccuracies in information supplied by third-party manufacturers.

7.3 Personalization and automated features

If a Product offers AI or machine-learning features, suggestions, plans or guidance generated by those features come from an automated system. Their usefulness depends on the accuracy, completeness and currency of the information available, including what you supply during onboarding and later use.

Automated wellness personalization may involve profiling as described in the Privacy Policy. It does not create medical advice or a clinical diagnosis. An automated system cannot consider every health nuance, personal circumstance or physical limitation. Use your own judgment and consult a suitable professional before acting on intensive exercise or dietary suggestions.

7.4 Outcomes and personal responsibility

We promise no particular health, fitness, learning or wellness result. Outcomes vary with your physical and mental condition, existing health issues, genetics, consistency, information supplied, motivation, lifestyle, sleep, stress, environment and access to care. Changes in circumstances, interrupted use or departure from a plan can affect progress.

Testimonials, case studies and before-and-after examples describe individual experiences. They are illustrative, may not be typical and do not promise similar results. Assess your own progress and seek professional advice before making significant health-related changes.

You voluntarily choose whether to participate in activities and remain responsible for your decisions. Subject to mandatory law and Section 10, we disclaim responsibility for outcomes, injuries or health consequences arising from use, misuse or reliance on information instead of professional care. Nothing excludes liability for injury or defective products where the law prohibits exclusion.

8. General warranties and availability

Except for express commitments and rights required by law, the Service and Content are supplied “as is” and “as available”. To the extent legally permitted, we exclude implied warranties, conditions and representations concerning merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy and reliability, including those arising from a course of dealing, performance or trade usage.

We do not guarantee that a Product will meet every expectation, operate continuously, remain free of errors, delays or security breaches, produce accurate results in every situation, or have every defect corrected. This does not exclude applicable legal guarantees of conformity or obligations to supply necessary security updates.

Information from us, external providers or users is general information, rather than legal, financial, psychological, medical or other professional advice. Obtain advice from an appropriately qualified person before relying on it for decisions requiring that expertise.

Maintenance, technical problems and events outside our control may interrupt access. We may modify or discontinue content, offers, functionality, data access or platform availability, subject to Section 4.3, purchase commitments and applicable law. Any exclusion of liability for interruption, downloaded materials, device damage or data loss is subject to Section 10.

You are responsible for complying with laws applicable to your use. We do not represent that every Product is suitable or available in every country. Mandatory consumer guarantees and remedies—including those in the European Economic Area, United Kingdom, United States, Australia, New Zealand and other applicable jurisdictions—take priority over these disclaimers.

9. Your responsibilities and prohibited conduct

You confirm that you are at least 18, have legal capacity, provide truthful and current information, and will use the Service only lawfully and as authorized. You must not access it from a territory where applicable sanctions or embargoes prohibit that access, or use it while identified on an applicable prohibited-party list.

Unless we expressly authorize it or a non-excludable legal right permits it, you must not:

  • Access the Service using bots, scripts, scrapers or other automated or nonhuman methods; collect or harvest its information through automated or manual means.
  • Copy, sell, distribute, publicly display or exploit the Service or Content; reverse engineer, decompile, disassemble, translate or alter its software; or use it to build competing products or derivative works.
  • Disrupt performance or security, introduce malware, defeat access controls or attempt to enter another person's account or an unauthorized part of the Service.
  • Submit content that is defamatory, abusive, threatening, unlawfully offensive, fraudulent, misleading, otherwise harmful, or infringes intellectual-property, privacy or other rights; or promotes unlawful activity.
  • Send spam, unsolicited advertising or unauthorized commercial messages, or frame or mirror the Service without written permission.
  • Impersonate another person, misrepresent your identity, or misuse reporting, feedback or help functions through false or malicious claims.
  • Harass, threaten, abuse or otherwise mistreat support staff, coaches, employees, partners or other users.

Communicate respectfully with our representatives. If we determine that your conduct is abusive, threatening, harassing or otherwise inappropriate, we may end account access immediately, subject to applicable law and any non-excludable rights to notice or remedies.

10. Limits on liability

To the fullest extent permitted by law, neither the Company nor its affiliates, officers, directors, employees, agents, licensors or suppliers is liable for indirect, incidental, special, punitive or consequential loss. This includes loss of profits, goodwill or data and, where lawful, injury or property damage arising from use or inability to use the Service, user or third-party conduct, information obtained through it, or unauthorized access to or alteration of transmissions or content.

These exclusions apply whatever the legal basis of a claim, including contract, negligence, other tort or strict liability, and whether or not the possibility of loss was disclosed. They apply only to loss that may lawfully be excluded.

Subject to the exceptions below, if you paid us for access during the 12 months immediately before the event giving rise to a claim, our aggregate liability for all claims arising from these Terms or the Service is limited to the amount paid during that period. If you paid nothing during that period but we offered a paid subscription plan at the time of the event, the cap equals one month of the lowest-priced paid subscription plan then offered. If you paid nothing and no paid subscription plan existed, this paragraph imposes no monetary cap.

No provision excludes or limits fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, death or personal injury caused by negligence where protected by law, or any other liability that cannot lawfully be restricted. Applicable consumer and product-liability protections prevail. An unenforceable limitation does not invalidate the remaining lawful provisions.

For consumers in the European Economic Area, United Kingdom or Switzerland, if defective digital content we supply damages your device or other digital content, we will repair the damage or compensate you. Subject to mandatory law, this does not cover damage avoidable by installing a free update we advised you to apply, or caused by failure to follow supplied installation instructions or disclosed minimum system requirements.

11. Claims arising from your conduct

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless the Company, its affiliates, subsidiaries, partners, licensors, service providers, officers, directors, employees and agents against claims, losses, liabilities, damages, debts, obligations, costs and reasonable legal fees arising from your use of the Service or User Content; a breach of these Terms or law; infringement of another person's rights; or a misrepresentation or submission that causes loss or liability.

We may assume exclusive control of the defence of an indemnified matter at your expense, subject to applicable law, and you agree to provide reasonable cooperation. You must not settle without our prior written consent unless the settlement fully releases us, imposes no obligation on us and includes no admission of our fault. We will make reasonable efforts to notify you promptly when we learn of a claim covered by this section.

This section does not impose liability on a consumer where prohibited by law or require indemnification for liability that we cannot lawfully transfer to you.

12. Governing law and resolving disputes

12.1 General law and courts

Except for the United States provisions below, Lithuanian law governs these Terms and related claims, without applying conflict-of-law rules to remove mandatory protections. Subject to the consumer exception that follows, proceedings brought by the Company will be brought in the courts of Vilnius, Lithuania.

If you are a consumer in the European Economic Area, United Kingdom, Switzerland or another jurisdiction with mandatory consumer protections, you may bring proceedings in your country of habitual residence where applicable law permits. We will bring proceedings against you only in the courts of your country of residence where required by those protections. The governing-law choice does not deprive you of mandatory rights available under applicable consumer law.

12.2 Complaints

Contact hello@yellow43.com with a complaint so that we can try to resolve it. You retain access to competent courts and any consumer complaint or dispute-resolution procedure available under applicable law. We do not otherwise commit to a particular voluntary alternative dispute-resolution scheme.

12.3 United States law

If you reside in the United States, Delaware law governs these Terms and related disputes, without its conflict-of-law rules and subject to mandatory federal and state protections. The international convention governing contracts for the sale of goods does not apply. The Federal Arbitration Act governs the arbitration agreement below and related court proceedings.

12.4 Agreement to arbitrate and appointment

Subject to the exceptions and opt-out below, you and the Company agree to resolve any dispute, claim or controversy concerning these Terms or the Service through binding individual arbitration before a neutral arbitrator. To the extent permitted by law, the arbitrator decides questions about the arbitration agreement's interpretation, applicability, enforceability or validity; questions the law reserves to a court remain for that court.

The parties will seek to agree on an independent arbitration administrator experienced in consumer disputes. Its published consumer rules, supplied to both parties before proceedings begin, will govern procedure subject to this section and mandatory law. If the parties cannot agree on an administrator or arbitrator, or the agreed appointment process fails, either may apply to a court with jurisdiction for appointment of a neutral arbitrator under Section 5 of the Federal Arbitration Act.

If no administrator is appointed, the court-appointed arbitrator will conduct the proceedings under this agreement and the Act, determine necessary procedural arrangements after hearing both parties, and allow each a fair opportunity to present relevant evidence and respond. Arbitration will be before one arbitrator, except that a different arbitrator may serve each batch under Section 12.7. Failure to agree on an administrator does not by itself end this arbitration agreement.

12.5 Informal resolution first

Before commencing arbitration, both parties will try to resolve the dispute informally for 30 days. Send a written Notice of Dispute to hello@yellow43.com stating your name, contact information, the issue and the remedy you seek. We will send our notice to your account email or another contact address you have supplied for the dispute. If the matter remains unresolved 30 days after receipt, either party may start arbitration.

12.6 Individual claims

To the extent permitted by law, each party may bring claims only in its own capacity, not as a representative or member of a class, collective or representative proceeding. Except for the coordinated administration expressly agreed in Section 12.7, claims may not be consolidated. The arbitrator may award relief only for the individual parties whose claims are properly before that arbitrator.

12.7 Coordinated mass filings

If 25 or more similar disputes are brought through the same or coordinated counsel, or are otherwise coordinated, they constitute a mass filing. The parties agree to administration in successive batches of up to 50 disputes, with one consolidated arbitration, one filing fee per side, one arbitrator and one venue for each batch.

The parties will cooperate in good faith with the administrator or arbitrator to implement this process, including staying remaining individual disputes while earlier batches are resolved, to reduce unnecessary cost and duplication. Each claimant retains an individual claim and entitlement to individual relief; batching does not authorize a class or representative award. These procedures apply only so far as consistent with applicable law and the consumer safeguards governing the proceedings.

12.8 Small claims and permitted court applications

Either party may bring an eligible claim in a small-claims court with jurisdiction instead of arbitration, provided it proceeds individually. Either party may also seek temporary or preliminary court relief to protect intellectual property or prevent unauthorized use of the Service, or apply to confirm, enforce or vacate an award as the Federal Arbitration Act permits.

12.9 Hearings and location

Proceedings will normally take place through written submissions, telephone or video. If an in-person hearing is required, you may choose your state of residence or New Castle County, Delaware, subject to any more protective mandatory rule. The arbitrator will determine appropriate arrangements for a batch consistently with the applicable consumer safeguards.

12.10 Costs, authority and award

Fees are allocated under applicable consumer rules and law. If you initiate arbitration, you will not be required to pay more than the filing fee for a lawsuit in a court with jurisdiction. We will pay remaining administrator and arbitrator fees to the extent required by the applicable consumer rules or law; where proceedings have no administrator, we will pay those remaining arbitration fees. Each party pays its own lawyers and other costs unless an award reallocates them as applicable law permits.

The arbitrator may grant any individual remedy available under applicable law. The award is final and binding, subject to the limited court review provided by the Federal Arbitration Act. A court with jurisdiction may enter judgment on the award.

12.11 Thirty-day opt-out

You may reject this arbitration agreement by sending written notice to hello@yellow43.com within 30 days after accepting these Terms. Include your name, contact details and a clear statement that you opt out of mandatory arbitration. The rest of these Terms continues to apply.

12.12 Time limit for claims

To the extent permitted by law, a dispute brought by a United States resident must be filed within one year after the claim could first have been brought; otherwise it is barred. That period is paused during the informal-resolution process in Section 12.5. Any mandatory longer period or other protection required by law prevails.

12.13 Jury waiver and severability

Where legally permitted, each party waives trial by jury if a dispute proceeds in court. An invalid part of Sections 12.3–12.13 will be limited to what is enforceable or severed without disturbing the remaining provisions. However, if the class or representative waiver in Section 12.6 is unenforceable for a particular claim or remedy, the arbitration agreement does not apply to that claim or remedy, which may proceed in court.

13. Other provisions and consumer protections

13.1 Agreement, assignment and interpretation

These Terms, the Privacy Policy and any applicable additional terms actually supplied and incorporated under Section 1.3 form the agreement concerning the Service and supersede earlier agreements or communications on that subject.

To the extent permitted by law, we may transfer our rights and obligations to an affiliate, subsidiary or successor through a merger, acquisition, restructuring or asset sale without your prior consent or notice. This does not remove mandatory consumer protections. You may not transfer this agreement or your rights or obligations without our written consent.

If a provision is invalid, it will apply only to the extent enforceable, with the remainder continuing in effect, subject to the special arbitration rule above. Not enforcing a provision immediately does not waive it. A waiver by the Company must be written and signed.

13.2 Providers and events beyond our control

Where relevant features exist, we may use external providers for hosting, payments, support, analytics or other operational functions. Personal-data processing is governed by applicable law and explained in the Privacy Policy. This clause does not assert that every listed function is currently used.

We are not responsible, to the extent permitted by law, for delay or failure caused by events outside our reasonable control, including natural disasters, war, terrorism, unrest, labour disputes, power or communications failures and government action. This does not remove remedies that mandatory law provides.

13.3 Electronic communications

Where the Service supports transactions or notices, you agree to electronic communications as permitted by law. These may arrive by email, in-product messages, push notifications or website notices. Electronic acceptance actions, such as selecting an agreement button, can express your agreement and act as an electronic signature where legally effective. Keep any contact information you supply current and ensure you can receive relevant notices.

You may contact hello@yellow43.com to withdraw consent to electronic delivery. This may affect features that depend on it, subject to your legal rights and any required alternative delivery arrangements. Agreement to contractual notices is not consent to marketing or unrelated personal-data processing.

13.4 Individual disputes outside the United States

Where permitted by applicable law, disputes will be pursued individually rather than through class, consolidated or representative proceedings. This provision does not apply where such a restriction is prohibited and does not restrict protected collective or representative remedies. United States disputes are governed by the more specific provisions in Section 12.

13.5 European Union consumers

Applicable EU and national law gives consumers rights concerning conformity of digital content and services, including agreed description, fitness for purpose, quality, performance and required updates. If the Service does not conform, you may be entitled to correction, a proportionate price reduction or termination and reimbursement under applicable law. No disclaimer in these Terms removes those protections.

13.6 Canadian consumers

Mandatory federal, provincial and territorial consumer rights prevail. Subscription disclosures, consent, renewals and cancellation must satisfy applicable requirements. Arbitration and class-action restrictions do not apply to Québec consumers to the extent prohibited. Where Québec language requirements apply, the required French version must be made available or provided before a valid agreement to another language; a request for French may also be sent to hello@yellow43.com. Mandatory language rules prevail over English-language precedence.

13.7 Australian consumers

Australian Consumer Law guarantees cannot be excluded, restricted or modified by these Terms. For a major service failure, applicable remedies include cancellation and a refund for the unused portion, or compensation for reduced value, together with compensation for reasonably foreseeable loss or damage. For other failures, you are entitled to the remedies required by law, including correction within a reasonable time. Any Company choice of remedy is subject to those rights.

13.8 New Zealand consumers

The Consumer Guarantees Act 1993 and Fair Trading Act 1986 provide rights that these Terms do not restrict. Failure to meet a consumer guarantee may entitle you to a remedy; a failure of a substantial character may entitle you to cancel and obtain a refund under applicable law. Local mandatory protections prevail over conflicting exclusions.

13.9 United Kingdom consumers

Your statutory rights include remedies where digital content or services are defective, not as described or unfit for purpose, as applicable under the Consumer Rights Act 2015 and other legislation. These can include repair, replacement, repeat performance, price reduction or an appropriate refund. Renewal and cancellation arrangements will comply with mandatory UK requirements in force for the relevant purchase.

13.10 United States consumers

Mandatory federal and state consumer protections prevail. Where state automatic-renewal rules apply, disclosures, consent, renewal and cancellation arrangements will comply with them. Liability exclusions, arbitration and other restrictions operate only to the extent permitted by applicable law.
